Welcome to BacBacGo ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BacBacGo website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Service.
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a minor, you represent that you are the parent or legal guardian and consent to the minor's use of the Service. We reserve the right to refuse access to the Service to anyone for any reason at any time.
You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet the eligibility requirements stated herein. If you do not meet these requirements, you must not access or use the Service.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately at support@bacbacgo.com of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
BacBacGo offers both free and paid subscription plans ("Pro Plans"). By subscribing to a Pro Plan, you authorize us to charge your chosen payment method on a recurring basis (monthly or annually, depending on your selection). All fees are quoted in Moroccan Dirhams (MAD) unless otherwise stated. Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing cycle. No partial refunds are provided for unused portions of a billing period. We reserve the right to change subscription pricing with 30 days' prior notice sent to your registered email address.
All content available through the Service — including but not limited to text, lessons, quizzes, graphics, logos, icons, images, audio, video, software, and code — is the property of BacBacGo or its licensors and is protected by Moroccan and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content on the Service without our prior written consent, except for your personal, non-commercial educational use.
Certain features of the Service use artificial intelligence ("AI") to generate feedback, grading, and recommendations. While we strive for accuracy, AI-generated content is provided "as-is" and may contain errors, inaccuracies, or omissions. AI-generated feedback does not constitute official academic evaluation and should not be relied upon as a substitute for professional educational assessment. You acknowledge and agree that BacBacGo shall not be held liable for any decisions made based on AI-generated content.
You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) upload, transmit, or distribute any viruses, malware, or other harmful code; (e) use automated means (bots, scrapers, crawlers) to access the Service without our written permission; (f) share your account credentials with others or allow multiple individuals to use a single account; (g) attempt to manipulate or abuse the referral system, promotions, or coupon codes; (h) harass, abuse, or harm other users of the Service.
We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or third parties, or for any other reason. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated personal data at any time through your account settings. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, and limitations of liability.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. BACBACGO IS AN EDUCATIONAL TOOL AND DOES NOT GUARANTEE ANY SPECIFIC ACADEMIC RESULTS, GRADES, OR EXAM OUTCOMES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BACBACGO, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Casablanca, Morocco. Before initiating any formal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@bacbacgo.com.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to your registered address or through a prominent notice on the Service at least 14 days before they take effect. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must discontinue use of the Service.
